Probate

Probate is the process by which a court appoints someone (usually a close relative) to identify all the assets that a recently departed person owned (known as the "estate") as well as liabilities he or she owed, and to notify all the person's relatives. If the person died without a will, the court will distribute the estate according to the laws of the state and some of the estate's assets may become property of the state. If the person wrote a will, the probate process will include a reading of the will and distribution of the estate property according to the will's terms.

The probate process is both time consuming and costly. For this reason, many people arrange their assets in a way that avoids the probate process.
